This Consumer Health Data Privacy Policy is provided by Vital View 3D Breast Imaging (“Vital View 3D,” “we,” “us,” or “our”) under the Washington My Health My Data Act (RCW 19.373). It explains how we collect, use, and share “consumer health data” through vitalview3d.com and our related communications, and the rights you have over that data. It supplements our Privacy Policy.
What “consumer health data” means. Personal information that is linked or reasonably linkable to you and that identifies your past, present, or future physical or mental health status. For us, this includes information such as the reason you are requesting a breast scan, symptoms you describe, breast density, prior imaging or biopsies, family history, and the fact that you have requested or received breast imaging services. Health care information that is protected under HIPAA or Washington’s Uniform Health Care Information Act (RCW 70.02) is governed by those laws rather than by this policy.
1. Categories of consumer health data we collect
- Information you enter in our appointment and contact forms or share by email, phone, text, or fax about your breast health, symptoms, imaging history, breast density, and family history.
- Referring-provider information and the imaging order they issue for you.
- The fact that you have requested, scheduled, or received breast imaging services from us.
- Communications with us about your care, including appointment reminders and follow-up.
We do not collect precise geolocation data, and we do not use geofencing around any health care facility.
2. Sources
We collect consumer health data directly from you, from your referring health care provider, and, once you are a patient, from the imaging we perform.
3. Purposes
We collect and use consumer health data only to:
- respond to your enquiry and determine whether a Vera Scan (breast CT) is appropriate and properly ordered;
- schedule, confirm, and provide breast imaging services and coordinate with your providers;
- communicate with you about your appointment, results, and follow-up care;
- maintain records required by law and protect the security of our systems; and
- comply with legal obligations.
We do not use consumer health data for targeted advertising, and we do not sell it.
4. Categories of consumer health data we share, and with whom
We share consumer health data only as needed for the purposes above, with:
- Your health care providers (for example, the provider who ordered your scan) to coordinate and deliver your care.
- Processors acting on our behalf, who are contractually limited to handling data for us: website hosting and form processing (GoDaddy, WPForms), email delivery (Brevo), business email and document storage (Microsoft 365), and our imaging, scheduling, and payment systems.
- Legal and safety recipients when required by law or to protect the safety of any person.
We do not share consumer health data with affiliates or third parties for their own purposes, and we do not sell consumer health data. Because we do not sell it, no “valid authorization” for sale is requested.
5. Your rights
As a Washington consumer you have the right to:
- Confirm whether we are collecting, sharing, or selling your consumer health data, and access it, including a list of the third parties and affiliates we have shared it with and how to contact them.
- Withdraw consent to our collection or sharing of your consumer health data.
- Delete your consumer health data, subject to legal record-keeping requirements for health care records.
To exercise these rights, email info@vitalview3d.com with the subject line “Consumer health data request,” or call (425) 500-6228. We will verify your identity and respond within 45 days (extendable once by 45 days where reasonably necessary, in which case we will tell you). If we deny your request, you may appeal by replying to our response with the word “Appeal.” We will respond to your appeal within 45 days. If your appeal is denied, you may contact the Washington State Attorney General at atg.wa.gov/file-complaint.
We will not discriminate against you for exercising your rights.
6. Security and retention
We restrict access to consumer health data to people who need it to provide your care or operate our business, and we use reasonable administrative, technical, and physical safeguards. We keep consumer health data only as long as needed for the purposes above or as required by law.
7. Changes
We may update this policy. The effective date above shows when it was last changed.
